Competition Terms and Conditions:

1. There are two prizes on offer and for each prize drawn, the winner will receive, Caltex StarCash# gift cards, to the value of $5,000 (G.S.T. inclusive). The total prize pool value on offer is $10,000.
2. Participation in this promotion constitutes acceptance of these terms and conditions of entry.
3. To enter the competition draw you must have internet access and:
   1. visit in-store at any participating retailer and
   2. spend $50.00 or more on any Aqua One, Avi One, Pet One, Pond One and Reptile One branded product/s* (goods) between 1st November, 2008 and 31st January, 2009 inclusive and
   3. receive in-store one or more competition entry tickets, scratch the scratch panel to reveal a unique ticket number and
   4. register your entry online at www.aquaone.com.au/freefuel by submitting your unique ticket number/s and completing a short questionnaire
   5. online registration must be completed between 1st November, 2008 and no later than 11:59:59 PM, Saturday 31st January, 2009
4. Upon registering your entry and unique ticket number/s online, you will be required to keep all original competition entry ticket/s and the original proof of purchase (receipts). The prize winners are required to present this information, to the promoter, to validate their winning entry. Liability for lost, destroyed or illegible entry confirmation page/s, receipts or entry tickets, is the responsibility of the competition entrant/purchaser of goods.
5. There will be two unique winning entries drawn where each winning entry shall not be the same person.
6. The winners will be drawn on Wednesday, 25th of February, 2009 at belong, Level 9, 155 George St, Sydney NSW 2000 at 11am AEST. Each winner will be drawn randomly via an approved computerised system and by a licensed operator.
7. The competition entry is only open to persons 18 years and over who are residents of NSW, ACT, VIC, QLD, WA, SA, TAS and NT in Australia.  Persons 17 years and under (child) may purchase eligible goods and be granted competition entry tickets, however, a parent/guardian only may use and enter these tickets into the competition draw where registration details provided are in their own name and not the child’s name.
8. The promoter’s employees, their immediate families, retail customers, suppliers, agents, associated companies and business associates, and all their employees and immediate families, are ineligible to register and enter into this competition.
   1. Entry tickets will be granted in-store, at participating retailers and during the competition period only.
   2. The minimum goods purchase value of $50 and two prize values of $5000 each are considered inclusive of G.S.T, for competition purposes.
9. Goods prices may vary between participating retailers, and from store to store.
10. Not all goods*, including sizes, styles and colours, are available at all participating retailers and the retailer and promoter shall not be held liable for out of stock or unavailable goods.
11. For every $50 whole portion amount spent on eligible goods ONE competition entry ticket will be granted, at time of purchase and to the purchaser of those goods. Amounts that do not reach the next full whole $50 value will not qualify for an entry ticket. For example, spend $98.50 on nominated goods, and receive one competition entry ticket only. Spend: $100 = 2 tickets, $200 = 4 tickets, $500 = 10 tickets and so on.
12. Goods must be purchased in the competition purchase period only and as a single transaction, and only the purchase values of eligible goods will be calculated in order to qualify for competition entry tickets.
13. The same competition entrant may enter the competition an unlimited number of times during the competition period, but each ticket number may only be registered once. The registrant may register one or more of their unique ticket numbers together at the same time. Each unique ticket number registered is deemed as one entry into the prize draw for competition purposes.
14. No other forms or methods of registration will be accepted for this competition.
15. The promoter, its employees and agents, will not be held liable for any claims and/or damages, including direct, indirect, punitive, incidental, special or consequential damages, or for personal injury arising out of, or in any way connected with this promotion, except for any liability which cannot be excluded by law, including without limitation to, your access to and operation of the internet, the promoter’s website and online registration of your competition entry ticket/s, including where equipment and programming failures and technical error occurs,  or where data received in relation to your registration and entry is without limitation, incomplete, false or has been subject to unauthorised access and tampering.
16. All entries deemed valid by the promoter will be entered into the prize draw and the promoter may require the entrant to validate any one or all of their entries in the promotion at any time during the promotion and to be eligible to claim a prize. Any entry deemed by the promoter to have been tampered with or not in accordance with the competition terms and conditions will be disqualified from the prize draw without any further notice or advice. The promoter may require a winner to provide proof of identity, proof of age and proof of residential address to be eligible to claim a prize. The promoter’s decision will be final and no further correspondence will be entered into.
17. The initial cost of freight and handling charges for delivery of prize/s will be borne by the promoter, but where a prize is undeliverable, without limitation, due to incorrect information provided by the prize winner or where the prize cannot be accepted as signed for, further charges to deliver the prize will be borne by the prize winner and delivery charges pre-paid. Once prizes have left the Promoter’s premises, the Promoter takes no responsibility for prizes damaged, delayed or lost in transit.
18. Winners will be notified in writing within 2 days of the prize draw. Prize/s will be delivered within 28 days of the prize draw date and sent via Registered Post.
19. Prizes are not transferable and cannot be exchanged or taken as cash. If the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value, subject to State Regulation.
20. In the event that for any reason whatsoever a winner does not take an element of the prize by the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize.
21. The prize winners will be published on the promoter’s website www.aquaone.com.au and published in the public notices section of “The Australian” on Wednesday 11 March 2009 and include each prize winner’s name (title, initial and surname only), suburb and state of residence. The prize recipients acknowledge and agree to allow the promoter to use such information for this and other marketing and announcement purposes in their industry newsletter and other owned websites and / or as described in paragraph 23.
22. The questionnaire contains mandatory fields requesting personal information, for example, your name, residential address, contact number/s and this information must be provided so as to proceed through entry registration and in order to validate your entry.
23. By participating in this promotion, the entry registrant agrees and accepts, even where an entry is deemed invalid, that all information provided, and collected, other than that information known by the promoter to belong to persons under the age of 18, may be used by the promoter to: a) conduct the promotion b) notify the winners c) facilitate future market and product research d) contact you, by email, post or telephone or e) provide information on products, special offers, promotions, or company and industry information and events, and f) maintain a database to manage and administer your personal information for the purposes explained herein and without any further reference, or payment or other form of compensation.
24. All entries are the property of the promoter. The promoter will not share or provide your personal information to any other third party, including participating retailers, except in order to facilitate and conduct the promotion or as required by law. 25. In the event that a prize is unclaimed, undeliverable or where the prize recipient is not contactable 3 months after the prize draw, the promoter reserves the right to award the prize to another entrant. Subject to any written direction given under legislation 37 of the Lotteries and Gaming Act 1993 (SA), an unclaimed prize draw will take place at the same time and place as the original draw on Monday 25 May 2009. Any winners will be published in the public notices section of “The Australian” on Monday 1 June 2009.
26. The competition may not to be used in conjunction with any other offer.
27. Where this promotion cannot be facilitated as planned, including for any cause beyond the promoter’s control, the promoter reserves the right to modify, suspend or terminate the competition subject to the approval of the gaming authorities in each state and territory accordingly.

29. In registering your entry into the WIN A YEAR’S FREE FUEL competition, you acknowledge and agree to the competition terms and conditions, including those terms and conditions of the Caltex StarCash# gift card, where you are the recipient of a prize.
30. # The winner/s acknowledge and agree that ownership of, and responsibility for, their prize of Caltex StarCash gift cards, shall be transferred immediately to them upon receipt of such and no further liability is accepted for those gift cards by the promoter.
31. The prize of WIN A YEAR’S FREE FUEL of $5,000, is calculated based on an average vehicle with a 63 litre fuel tank and one tank of fuel purchased per week at $1.50/litre, over one calendar year. For example $1.50/litre x 63 litres = $94.50/week of fuel, x 52 weeks/year = $4914.00. This has been rounded up to $5,000. Fuel consumption and fuel costs may vary, without limitation to, vehicle type/s, vehicle performance, vehicle age, driver handling and fluctuation in fuel prices. Therefore, the Caltex StarCash gift cards may be used in full, prior to one calendar year expiring. Caltex StarCash gift cards may be used at over 1800 participating Caltex service stations across Australia to purchase fuel and other products in-store, subject to the StarCash gift card’s terms and conditions.
